Terms for hosts who list parking spaces on Nearby.

Service Area Notice

Nearby currently operates in a limited set of cities. See the up-to-date list on our Cities page. If your lot is outside our current service area, you can still reach out or create a listing for review — if you think you'd be a good fit, let us know and we may be able to expand to you. Submit your details on the expansion request form and we'll be in touch.

1. Introduction

Welcome to Nearby's Host Program. By agreeing to these terms, you are entering into a binding agreement with Nearby, Inc. ("Nearby," "we," "us," or "our") to list your parking space(s) on our platform and receive payments for bookings made by users ("Parkers").

2. Eligibility

To become a Host on Nearby, you must:

  • Be at least 18 years of age
  • Have the legal right to offer the parking space for rent (ownership, lease with subletting rights, or written permission from the property owner)
  • Ensure the parking space complies with all local zoning laws, HOA rules, and applicable regulations
  • Provide accurate and truthful information about yourself and your parking space

3. Listing Your Space

As a Host, you agree to:

  • Provide accurate descriptions, photos, and availability information for your parking space
  • Keep your listing information current and update availability promptly
  • Ensure the parking space is safe, accessible, and as described in your listing
  • Not discriminate against any Parker based on race, religion, national origin, disability, sex, gender identity, sexual orientation, or any other protected characteristic

4. Pricing and Payments

You set your own prices for your parking space. Nearby charges a service fee of 20% on each booking, which is deducted from the booking amount before payout. Payments are processed through Stripe, our payment processor. You must complete Stripe's verification process to receive payouts.

  • Payouts are typically processed within 2-7 business days after a booking is completed
  • You are responsible for reporting and paying any applicable taxes on your earnings
  • Nearby may provide tax documentation (such as 1099 forms) as required by law

5. Cancellations and Refunds

You may set your own cancellation policy within the options provided by Nearby. If you cancel a confirmed booking, you may be subject to penalties including but not limited to:

  • Automatic refund to the Parker
  • A cancellation fee charged to your account
  • Negative impact on your Host rating and search ranking
  • Suspension or termination of your Host account for repeated cancellations

6. Liability and Insurance

Nearby provides limited Host protection for verified bookings made through our platform. However, you acknowledge that:

  • You are responsible for maintaining adequate insurance coverage for your property
  • Nearby is not liable for any damage, theft, or injury that occurs on your property
  • You should consult with your insurance provider about hosting activities
  • You agree to indemnify and hold Nearby harmless from any claims arising from your hosting activities

7. Prohibited Activities

As a Host, you agree NOT to:

  • List spaces you do not have the right to rent
  • Misrepresent the location, size, or condition of your parking space
  • Conduct transactions outside of the Nearby platform to avoid fees
  • Harass, threaten, or discriminate against Parkers
  • Use the platform for any illegal purposes

8. Account Termination

Nearby reserves the right to suspend or terminate your Host account at any time for violation of these terms, fraudulent activity, repeated complaints from Parkers, or any other reason at our sole discretion. You may also close your Host account at any time by contacting support.

9. Modifications to Terms

Nearby may modify these terms at any time. We will notify you of significant changes via email or through the platform. Continued use of the Host services after changes constitutes acceptance of the modified terms.

10. Dispute Resolution

Any disputes arising from these terms or your use of the Host services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits against Nearby.
